1344 discrimination on account of race, color, creed, religion, national origin, 1345 gender, marital status, status with regard to public assistance, sexual 1346 orientation, disability, or age. 1347 12.5.2 All Parties agree to comply with all federal, state and local laws or 1348 ordinances, and all applicable rules, regulations, and standards established 1349 by any agency of such Governmental Units, which are now or hereafter 1350 promulgated insofar as they relate to the Parties' performance of the 1351 provisions of this Agreement. 1352 12.6 Data Practices 1353 12.6.1 All data collected, created, stored, received, maintained or disseminated for 1354 any purpose in the course of any Party's performance of this Agreement is 1355 governed by the Minnesota Government Data Practices Act, Minn. Stat. Ch. 1356 13, or any other applicable state statutes, any state rules adopted to 1357 implement the Act and statutes, as well as federal statutes and regulations 1358 on data privacy. 1359 12.7 Management and Access to Data 1360 12.7.1 Each Party shall manage all data the Party collects, creates, stores, receives, 1361 maintains, or disseminates. Access to a Member's data by another Member 1362 shall be in accordance with the Minnesota Government Data Practices Act 1363 and other applicable federal, state, and local laws and rules governing data 1364 privacy. 1365 12.8 Audit 1366 12.8.1 Until the expiration of six (6) years after the termination of this Agreement, 1367 each Party shall, upon written request of another Party, make available to 1368 the requesting Party, the State Auditor or the requesting Party's ultimate 1369 funding sources, a copy of this Agreement and the books, documents, 1370 records and accounting procedures and practices relating to this Agreement. 1371 12.8.2 All parties will comply with and address audit findings. 1372 12.9 Alteration 1373 12.9.1 Any alteration, variation, modification, or waiver of the provisions of this 1374 Agreement shall be valid only after it has been reduced to writing in the form 1375 of an amendment and duly signed by all Parties. 1376 12.10 Notice 1377 12.10.1 Any notice required to be given by this Agreement shall be made by 1378 delivery by first class mail, postage applied, to the person holding the title 1379 and at the address identified on the Party's signature page. 1380 12.11 Interpretation of Agreement; Venue 1381 12.11.1 This Agreement shall be interpreted and construed according to the laws of 1382 the State of Minnesota.
