qlxse�fh� <br />REQUEST FOR COUNCIL ACTION <br />Date: 12/09/2013 <br />Item No.: 7.i <br />Department Approval City Manager Approval <br />Item Description: Consider Approving a Lease Agreement with New Cingular Wireless (AT &T) at <br />the City Hall Campus North Communication Tower <br />1 BACKGROUND <br />z Over the past several months, City Staff and New Cingular Wireless (AT &T) have been in discussions on <br />3 entering into a lease agreement which would allow New Cingular to locate their wireless equipment on the <br />a City Hall Campus North Tower. Both parties have mutually agreed to the terms and conditions of the <br />5 Agreement and it awaits formal Council approval. <br />ell <br />r Under the Agreement, New Cingular Wireless will construct an 11.5'x 28' equipment shelter (322 square <br />8 feet) alongside the existing north wall of the Public Works site near the base of the tower. Due to its size, <br />9 the shelter required a variance to City Code Chapter 1011: Property Performance Standards, which limited <br />lo the size for telecommunication facility support buildings to only 200 square feet. This is similar to the <br />11 variance Verizon received earlier this year for its equipment shelter at the Reservoir Woods Tower. The <br />12 Variance Board approved New Cingular's request at their September 4th meeting. <br />1? <br />14 The terms and conditions of the Lease Agreement are consistent with prior agreements. The Agreement <br />15 covers an initial 5 -year term with the option to renew for up to 20 more years. A copy of the Agreement is <br />16 included in Attachment A. Attachment B includes a site plan. City Staff will be available at the meeting to <br />17 address any questions. <br />18 POLICY OBJECTIVE <br />9 The proposed Lease Agreement at the City Hall Campus North Tower is consistent with City Code <br />20 requirements for co- locations of wireless service providers as well as past practices. The lease agreement <br />21 will provide non property -tax revenue to support City functions. <br />22 FINANCIAL IMPACTS <br />zs The lease agreement call for the City to receive $29,000 annually (adjusted for inflation). <br />24 STAFF RECOMMENDATION <br />25 Staff recommends approval of the lease subject to final approval by the City Attorney. <br />26 REQUESTED COUNCIL ACTION <br />27 Motion to approve the lease agreement with New Cingular Wireless PCS LLC, for leased space at the City <br />28 Hall Campus North Communication Tower, subject to final approval by the City Attorney. <br />Page 1 of 2 <br />
