51 Works Department in addition to coordinating the review of the proposal by the Planning <br />52 Commission and City Council. <br />53 5.0 PUBLIC COMMENT <br />54 As of the time this report was prepared, Planning Division staff has received one phone <br />55 call inquiring about the proposal from nearby property owners, but no comments were <br />56 offered. The duly- noticed public hearing for this application was held by the Planning <br />57 Commission on December 4, 2013; draft minutes of the public hearing are included with <br />58 this RCA as Attachment E. Upon the conclusion of the public hearing, the Planning <br />59 Commission voted unanimously (i.e., 6 -0) to recommend approval of the proposed <br />60 vacation. <br />61 6.0 RECOMMENDATION <br />62 Based on the comments and findings outlined in Sections 4 — 5 of this report, the <br />63 Planning Division recommends approval of the VACATION of the remnant right -of -way <br />64 easement overlying the 30-foot by 17 -foot rectangle identified as Parcel 2 on the <br />65 Highcrest Park 5th Addition preliminary plat. <br />66 7.0 POSSIBLE COUNCIL ACTIONS <br />67 7.1 Adopt a resolution to approve the proposed VACATION of the remnant right -of -way <br />68 easement at 2305 Walnut Street as recommended, based on the comments and findings <br />69 of Sections 3 — 5 and the recommendation of Section 6 of this RCA. <br />70 7.2 Pass a motion to table the item for future action. Tabling beyond December 14, 2013 <br />71 would not be affected by the 60 -day action deadline established in Minn. Stat. § 15.99. <br />72 7.3 Adopt a resolution, to deny the requested approval.
