<br />23 West. <br />WHEREAS, the Roseville City Council held a hearing regarding the roadway easement <br />vacation on May 23, 1994 and determined the roadway easement should be vacated; and <br /> <br />WHEREAS, the necessary approved roadway easement documents were not recorded within <br />the required six month time line and became null and void; and <br /> <br />WHEREAS, Section 1013.04 of the Roseville Zoning Ordinance outlines the procedure for <br />vacation street or ally ways; and <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council (the "Council") ofthe City of <br />Roseville, Minnesota (the "City"), Ramsey County, Minnesota, that roadway easement documents <br />number 2191187, 1579619, and 1716354 covering a portion of Cohansey Street between Lovell <br />Avenue and Minnesota Avenue, be vacated, subject to: <br /> <br />A. Easements for public or private purposes, including, but not limited to, water lines, sewer <br />mains, telephone lines and poles, gas and electric, and cable television lines, including <br />the right to maintain the same or enter upon such land or portion thereof vacated, to <br />maintain, replace, remove, or otherwise attend thereto, existing on the date of this <br />vacation, shall be preserved and maintained by said utility holder pursuant to Minnesota <br />Statute Section 160.29 <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Mastel, and upon vote being taken thereon, the following voted in favor: Mastel, <br />Goedeke, Maschka, Wiski and Kysylyczyn <br />and the following voted against the same: None. <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />2 <br />
