8 3.0 BACKGROUND <br />s 3.1 The subject property has a Comprehensive Plan Land Use Designation of Industrial (I) <br />10 and a corresponding zoning classification of Industrial (I) District. The PRELIMINARY <br />11 PLAT proposal has been prompted by plans to develop an approximately 138,000- square- <br />12 foot office /warehouse facility on the proposed Lot 1. <br />1 �? 3.2 When exercising the so- called "quasi-judicial" authority when acting on a PLAT request, <br />14 the role of the City is to determine the facts associated with a particular request and apply <br />15 those facts to the legal standards contained in the ordinance and relevant state law. In <br />16 general, if the facts indicate the applicant meets the relevant legal standard, then they are <br />17 likely entitled to the approval, although the City is able to add conditions to a plat <br />18 approval to ensure that the likely impacts to roads, storm sewers, and other public <br />19 infrastructure on and around the subj ect property are adequately addressed. <br />20 3.3 At its meeting of September 15, 2012 Roseville's Parks and Recreation Commission <br />21 reviewed a previous plat proposal of this property against the park dedication <br />22 requirements of § 1103.07 of the City Code; after reviewing that proposal, the Parks and <br />23 Recreation Commission recommended requiring a dedication of cash in lieu of land in <br />24 this location. At the time the PRELIMINARY PLAT application for the present proposal was <br />25 submitted, the Parks and Recreation Department Director determined that the <br />26 Commission's 2012 recommendation was still appropriate and, since the PRELIMINARY <br />27 PLAT approval and submission of the FINAL PLAT application both occurred in 2013, the <br />28 2013 calculation of park dedication remains valid even though the final approval will <br />29 occur in 2014. City Code §314 (Fee Schedule) established a park dedication amount <br />30 equal to 7% of the 2013 fair market value of the unimproved land to be platted, as <br />31 determined by the Ramsey County Assessor's office; with a 2013 valuation of <br />32 $1,73 3,700, the total cash dedication would be $121,3 59, to be collected prior to <br />33 recording an approved final plat at Ramsey County. <br />34 3.4 The proposed PRELIMINARY PLAT was approved as part of the City Council's Consent <br />35 Agenda on December 9, 2013 with the condition that the applicant continue working with <br />36 the Public Works Department to address easements and water and sewer infrastructure <br />37 requirements as necessary. <br />38 4.0 FINAL PLAT ANALYSIS <br />39 4.1 Plat proposals are reviewed primarily for the purpose of ensuring that all proposed lots <br />40 meet the minimum size requirements of the zoning code, that adequate streets and other <br />41 public infrastructure are in place or identified and constructed, and that storm water is <br />42 addressed to prevent problems either on nearby property or within the storm water <br />43 system. As a FINAL PLAT of an industrial property, the proposal leaves no zoning issues to <br />44 be addressed since the Zoning Code does not establish minimum lot dimensions or area. <br />45 The proposed FINAL PLAT is included with this report as Attachment C. <br />46 4.2 At the time this report was prepared, Roseville's Public Works Department staff was <br />47 continuing to work with the applicant to address the specific needs related to easements <br />48 to be dedicated on the FINAL PLAT, but felt that the remaining issues were minor enough <br />49 to address with conditions of approval rather than postponing City Council action until <br />50 the plat document addresses the easements correctly. <br />PF 12-013-RCA-0 I 1314.doc <br />Page 2 of 3 <br />
