FOR THE RECORD

June 19, 1987

Mr. Peter Ackerberg, of the Attorney General's Office, advised me,
on June 19, 1987, that Chapter 62, passed by the last Legislature,
does not apply to the 1987 Roseville Municipal Election.

Chapter 62 provides that the Primary Election shall be at least
six weeks prior to the General Election, and that Affidavits
of Candidacy shall be filed not more than ten nor less than eight
weeks before the Primary. If these requirements were used, the
period for filing affidavits would be July 14 through July 28.

Chapter 62 becomes effective August 1, 1987. Therefore, it is
Mr. Ackerberg's opinion that filing Affidavits of Candidacy in
July would not be legal.

-He indicated it was his opinion that Roseville should continue,
for 1987, to have its Primary two weeks prior to the General, and
filing of Affidavits six to eight weeks prior to the Primary.

cc: Roger Jensen
