<br />1104.04: PLAITING VARIATIONS AND MINOR SUBDIVISIONS: <br />In any case in which the compl~ance with tl1e provisions of the Title will învolve unnecessary hardship and failure to comply dce9 not <br />interfere 'With the purpose of the platting reguJation, five (5) types of minor subdivisions may be granted: <br /> <br />A. Common Wall Duplex Subdivision: A common wall duplex mioor subdivision !Day be approved by the City Manager upon <br />recommendation of the Community Development Director. The owner shall file with the Comnronity Development Director three <br />(3) copies of a <:ertificate of sw-vey prepared by a registered land surveyor showing the parcel or lot, the proposed division, all <br />building and other structures or pavement locatiOt1S and a statement that each unit of the duplex has separate utility connections. <br />This type of minor subdivision shnll be limited to a common wall duplex minOT subdivision of a parcel in an R-2 District or other <br />zoning dislrict which allows duplexes,. along a common wall of the structure and common lot line of the principle structure where <br />the structure meets all required setbacks except the common wan property line. Within 3ÌXty (60) days after approval by the City <br />Manager, the applkant for the common wall duplex minor subdivision shall record the subdivision and the certificate of survey <br />with the Ramsey County Recorder. Failure to record the subdivision within sixty (60) days shall nullify the approval of the <br />subdivision.". . <br /> <br />B. Recombination: To divide one recorded lot 01" parcel in order to permit the adding of a parcel of land to an abutting lot and create <br />two (2) buildable parcels, the proposed subdivisio~ in sketch plan form, shall be submitted 10 the City Council for approvaL No <br />hearing or Pl.anning Commission review is llecessary unless the proposal is referred to the commission by the Community <br />Development Director for clarification. The proposed recombination shall not cause any portion of the existing lots or parcels to be <br />in violation of this regulation or the zoning code. Within tbirty (30) days after approval by the City Council, the applicant shall <br />supply a certificate of survey to the Community Development Director and City Manager tàr review and approval. After <br />completion of the review and approval by the Community Development Director and City Manager, the SlJrvey sbaH be recorded <br />by the applicant with the Ramsey County Recorder within sixty (60) days after approval by the City Manager. <br /> <br />c.. Consolidations: The o"mer of two (2) or more contiguous parcels or lots of record may, subject to Commwrlty Deve lopment <br />Director and City Manager approval, consolidate said parcels or lots into one parcel of record by recording the consolidation with <br />Ramsey County Recorder as a certificate of survey .showing same, within sixty (60) days of approval. No hearing is necessary <br />ulúess the proposal is appealed by the applicant to the Cit}' Cowlcil. The proposed parcels shall not cause any portion of the <br />existing lots, parcels., or existing buildings to be in violation of this regulation or the zoning code. <br />. <br /> <br />D. COlTectÍOI1S: When a surveyor description of a parcel or lot has been found to be inadequate to describe the actual boundarie3~ <br />approval of a colTective subdh'¡sion may be requested. This type of subdivision creates 110 new lots or streets. The proposed <br />corrective subdivision, in sketch plan form,. along with a letter signed by all affected owners agreeing to tilt: new subdivision, .shall <br />be submitted to the City Council for apptOvai. No hearing or Planning Commission review is Ilccessary unless the proposal is <br />referred to the Conunis:rion by the Community Development Director for clarification. The proposed parcels shall not cause any <br />podion of the existing lots, parcels. or existing buildings to be in violation of this regulation or the zoning code. A certificate of <br />survey illustrating the corrected boundaries shall be required on all parcels. Witlún thirty (30) days after approval b}' lhe City <br />. . CmlI1cil, the applicant shaD supply the final survey to the Community Development Dire-ctor and City Manager for review and <br />\JA€. ~ approval. After completion °t the reyiew and approval by the Commun~ty .De;relopnlent Dire~ and City 1vlanager, 11~ .~ey <br />shall be recorded by the applIcant w~th the Ramsey County Recorderwrt~un Slxty (60) days. Failure to record thè subdlV1Sl011 <br />within sh..-ty (60) days shall nullify the approval of the subdivision. <br /> <br />E.
