CASE NUMBER:

S April, 1992

PLUDfING RBPORT

DATE:

2143

APPLICANT:

Donald Roberts

LOCATION:

2210 Terminal Road

ACTION REQUESTED:

variance for Sign
in Public Right-of-Way

PLUDfING CONSIDERATIONS:

1. BACKGROUND

Mr. Roberts owns an industrial building on the south side of
Terminal Road (-old County Road B-2) at Long Lake Road. When the
new B-2 Bridge was built a few years ago, the alignment of
Terminal Road in this area was altered, allowing it to swing north
to line up with the new bridge crossing over I-35W. Because of
this angled alignment, the City purchased more property than was
needed for the roadway, leaving a triangular-shaped remnant in
front of Mr. Roberts' building. Because of this unusual
arrangement, Mr. Roberts is claiming a loss of visibility for his
building and is requesting a variance to allow an easement for a
pylon sign to be placed in the right-of-way at a location similar
to what would be allowed if Terminal Road had a standard sO'-wide
right-of-way.

Because the City has been negotiating with Mr. Roberts for over
two years regarding the situation, the City Council considers
this application to be exempt from the moratorium on sign
variances adopted last December, and has referred it to the
planning commission for a recommendation.

2. DEVELOPMENT ANALYSIS

Comprehensive Plan & Zoning Code References

The property is guided Industrial and zoned I-1. The use of the
building is consistent with the zoning.

section 14.040 of the Code states that "signs shall not be
permitted within the public right-of-way or easements", with a few
exceptions, such as street signs. Business signs are not
allowed. The variance request is to this provision of the Code.
