Donald Roberts
Our File: 009813-880003

Dear Mr. Waldron:

Attached to this letter is correspondence received from Caroline
Beckman dated May 27, 1992 indicating that the Roberts' variance
request has been laid over by the council. Ms. Beckman's letter
outlines the concerns of the council indicated at the last council
meeting on May 26, 1992.

I have forwarded Caroline Beckman's letter to Don Roberts and have
reviewed with him the three additional criteria which the council
discussed on May 26th. Mr. Roberts has indicated that he is
willing to reduce the sign area 70 square feet and the sign height
to 20 feet and does not feel that he can agree to replace a pylon
with a low monument sign. Our client does not feel that a low
monument sign will afford sufficient visibility to his property and
the businesses of his tenants, especially in times of heavy snow
cover. Given the fact that the City's realignment of Terminal Road
has deprived his property of the visibility and access which it
formerly enjoyed, Mr. Roberts does not feel that this additional
requirement is appropriate and is of the opinion that it will
adversely impact his tenants and, accordingly, the value of his
property.

Don Roberts is out of town and will not be able to attend the
council meeting on June 8th. He has requested that I attend the
meeting on his beha1 f and discuss the matter further with the
council should they desire to do so and to represent his interests.

GAB:drc
encl
cc: Donald Roberts
