Gatlin, Public Works Director <br /> <br /> <br /> <br />Re: STATUS OF ROBERTS PROPERTY SETTLEMENT <br /> <br />..- <br /> <br />Date: February 11, 1992 <br /> <br />For over two years, the city has been dealing with Mr. Donald <br />Roberts in an attempt to settle his claim against the city for <br />purported damages due to loss of access to his property located <br />along Terminal Road near the intersection of Long Lake Road lying <br />westerly of the County Road B-2 bridge. The parcel in question <br />is approximately a one acre, triangular piece of excess city <br />right-of-way which lies between the new Long Lake Road and Mr. <br />Roberts existing business parcel. This property was acquired in <br />conjunction with the right-of-way acquisition for the B-2 bridge <br />and the reconstruction of Terminal Road west of the bridge. <br /> <br />Mr. Roberts alleged that the excess taking and the unusually <br />large parcel of property restricted his access to his property. <br />Accordingly, he asked for certain concessions from the city in <br />exchange for his dropping all possible claims against the city <br />for damages. The principle elements of the agreement are <br />summarized as follows: . <br /> <br />1. The city will grant a non-exclusive 36' wide vehicle/ <br />pedestrian access easement across the west portion of this <br />parcel centered on the west Roberts property line. <br /> <br />2. The city will grant to Mr. Roberts a perpetual non-exclusive <br />easement over the city property prohibiting construction of <br />any building, berme, wall,' fence, sight obstruction, or <br />stormwater pond to assure perpetual building site lines. <br /> <br />3. The city will grant Mr. Roberts and his tenants and heirs an <br />easement for the placement of signs on the city property <br />with such signs being limited to signs identifying or <br />relating to the businesses located on the adjacent Roberts <br />parcel. <br /> <br />4. The agreement shall run with the land and shall be <br />assignable to all successors. <br />
