For over two years, the City has been working with Mr. Donald <br />Roberts in an attempt to settle his claim against the City for <br />reported damages due to the loss of access to his property <br />located along Terminal Road near the intersection of Long Lake <br />Road lying westerly of the County Road B-2 bridge. There is <br />approximately a one acre parcel of excess City right-of-way <br />which lies between the new Long Lake Road and Mr. Robert's <br />existing business property. <br /> <br />2. As part of the settlement agreement, Mr. Roberts agreed to <br />apply for a variance to allow him to locate a sign on this <br />excess piece of right-of-way. <br /> <br />3. City ordinances require that signs not be located on public <br />right-of-way. <br /> <br />4. The proposed sign would be setback 54 feet from the curb of the <br />road which would coincide with the required 40 foot setback if <br />an 80 foot right-of-way was present. <br /> <br />5. The Planning Commission unanimously recommended approval of <br />Donald Roberts request for a variance wi th the following <br />conditions: <br /> <br />a. That the sign be moved at no cost to the City if the <br />right-of-way in question is needed for a public purpose in <br />the futuFe. <br /> <br />b. That the size of the machine not exceed 70 sq. ft. and the <br />height not exceed 20 feet. <br /> <br />Alternative: <br /> <br />1. Deny the variance based on the finding that no hardship or <br />practical difficulty exists. <br /> <br />2. Grant the variance if a hardship or practical difficulty exists <br />on the site. <br />
