We have had
discussions to eliminate the proposed fencing in lieu of the existing shrubs/trees that are
much more attractive and would have to be completely removed to accommodate any
fencing.

This letter is written in conjunction with Stu Thornly, Vice President of Grandview
Townhome Association. It is our agreement to leave the existing landscaping as is and
not to add or take away as of November 19,2001. The only remaining item to be finished
in the spring will be the balance of the Sod/Seeding.

Finally, as a point of clarification, McKinley Companies, Inc. will provide shields as
required to create a more downcast effect on the entire rear yard exterior lighting as
satisfied by Stu Thornly.

Should you have any questions, please feel free to call.

Sincerely,

W

Brent D.
