<br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 11-13-90 <br /> <br />ITEM NO.: <br /> <br />Department Approval: <br /> <br />Manager Reviewed: <br /> <br />Agenda section: <br /> <br />Hearings <br /> <br />Item Description: <br /> <br />Thomas Theisen/Welsh Company request for a <br />Special Use Permit and license for an <br />amusement room at the Welsh Crossroads <br />Shopping Center at 1655 County Road B-2. <br /> <br />At the October 3, 1990 Planning Commission meeting, a motion to deny <br />Thomas Theisen/Welsh Company's request for a Special Use Permit for <br />an amusement room at the Welsh Crossroads Shopping Center at 1655 <br />County Road B-2, based on neighborhood safety issues and potential <br />harm to market value of adjacent properties, failed on a 3-3 vote. <br /> <br />A motion to recommend approval of the Special Use Permit, with the <br />condition that a security plan be developed and reviewed every <br />twelve months and that a study be done by the applicant comparing <br />police calls at shopping malls with arcades versus those without <br />arcades, failed for lack of a second. <br /> <br />The Planning Commission unanimously recommended that the City <br />Council, in reviewing the Comprehensive Plan, should clar~fy the <br />policy of allowing amusement centers in the City because of the <br />security impact, the impact on public health, safety, and welfare, <br />and because of the impact on the surrounding neighborhoods. <br /> <br />The Council discussed this issue at the October 15 Council work <br />session, and directed staff to prepare a revised ordinance regarding <br />amusement room operations. This ordinance will be completed for <br />Council adoption at the November 13 meeting. It was staff's <br />recommendation that the Council continue action on the Thomas <br />Theisen/Welsh Company's request until the new ordinance is in place. <br /> <br />The Council, on October 22, 1990, continued consideration of this <br />request until November 13, 1990. Subsequent to the Council <br />consideration, the applicant has revised the hours of operation to <br />coincide with the Cityls curfew. <br /> <br />COUNCIL ACTION REQUESTED: Motion to approve the Thomas <br />Theisen/Welsh Companyls request for <br />Special Use Permit and license for an <br />amusement room at 1655 County Road B-2. <br />
