Page -2- <br />September 3, 1991 <br /> <br />concluded that while there remains concerns with respect to the <br />technical legal implications of Mr. Fenner's request, the practical <br />considerations are such that the Board's approval of this request is <br />warranted. <br /> <br />The primary consideration is the fact that due to the geography of <br />this site, it is extremely unlikely that this portion of the road <br />easement will even be economically useful for actual road surface. <br />There is a very steep embankment separating the current, actual <br />traveled road from this portion of the easement, and major engineering <br />and expense would be necessary in order for it to be so used. <br /> <br />CONCLUSION <br /> <br />Based on the geographic fractures of this area, our office has <br />concluded that the Board may vacate the portion of the said easement <br />in question. <br />
