<br />WATERKAIN EASEMENT <br />02-22-38 <br /> <br />THIS INDENTURE, made this 6th day of December, 1990 by and between <br /> <br />of the County of Ramsey, state of Minnesota, parties of the first part, and <br />the CITY OF ROSEVILLE, Ramsey County, Minnesota, a municipal corporation, <br />party of the second part. <br /> <br />WITNESSETH: That in consideration of the sum of $1.00 and other valuable <br />considerations in hand paid by the said party of the second part, said parties <br />of the first part do hereby grant and convey unto party of the second part, its <br />successors and assigns, a perpetual easement for underground water aains, <br />pipes and appurtenances under and across the following described property in <br />,. Ramsey County, Minnesota: <br /> <br />THE SOUTH 10 PEET OP THE NORTH 43 PEET OP THE FOLLOWING DESCRIBED PROPERTY: <br /> <br />The North 313.0 feet of Lot 8, st. Paul Park lying Easterly of the following <br />described line: Beginning at a point on the North line of section 2, <br />Township 29, Range 23, distant 175.0 feet East of the Northwest corner of said <br />Section 2; thence southerly at right angles a distance of 313.0 feet and <br />there terminating. <br /> <br />According to the plat thereof on file or of record in the office of <br />the Register of Deeds in and for said county and state. <br /> <br />which easement shall include the perpetual rights of said City of Roseville, <br />its successors or assigns, to construct, maintain, operate and repair <br />underground water mains, pipes and appurtenances over and across a strip of <br />land hereinbefore described, together with perpetual easement for ingress and <br />egress, all without additional compensation. <br /> <br />TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and <br />appurtenances thereunto belonging, or in anywise appertaining, to the said <br />party of the second part, its successors and assigns, forever. <br /> <br />IN TESTIMONY WHEREOF, the said parties of the first part have hereunto set <br />their hands the day and year first above written. <br /> <br />RETURN TO <br />This instrument was drafted by <br />the City of Roseville, Minnesota <br />Engineering Division <br />2660 civic Center Drive <br />Roseville, Minnesota 55113 <br />
