<br />John Palmer, Case No. 2179 <br /> <br />Page 2 <br /> <br />The final consideration relating to the fence encroachment on the <br />neighboring property is really a private matter between these property <br />owners and not something that the City needs to be involved with. <br /> <br />2. CONCLUSION <br /> <br />Certainly the most significant of all of the issues reviewed in this <br />report relates to the lack of concrete curbing around the parking lot. <br />From our discussions with Mr. Palmer, it is clear that he was not <br />aware that this was a requirement and that the contractor did the <br />resurfacing without a permit. Again, since this application does not <br />involve the expansion or redevelopment of the site in any matter, it <br />would not appear reasonable to make them rip up the curbing that has <br />just been installed to comply with the concrete curb requirement. Mr. <br />Palmer is aware that it is his responsibility to come back to the <br />Planning Commission with a proposed solution to this matter, which will <br />probably involve an agreement to install the concrete curbing within <br />some agreed upon time period. With the resolution of these matters, <br />we would recommend approval of the application. <br />
