To require them to conform to the building materials standards in the <br />Code would defy common sense and constitute a practical difficulty. <br /> <br />~cial Use Permit Issue <br /> <br />The Code states that a non-conforming use "may not be extended, expanded, intensified, or changed unless to <br />a conforming use" (Section 11.020). Normal maintenance and alterations are allowed, however, as long as this <br />does not "extend, expand, or intensify" the use (Section 11.050). <br /> <br />We believe the proposed buildings, although new structures, fall within the definition of normal maintenance <br />and alterations, since the new buildings will be housing the same functions as the old obsolete equipment. The <br />new buildings do not expand the capacity of the facility and, therefore, should not require a separate action for <br />a Special Use Permit. Amoco can add these new buildings to the facility and maintain its status as a legal <br />non-conforming use. <br />
