<br />jlqC¡ <br /> <br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 2-25-91 <br />ITEM NO.: C. -;)- <br /> <br />Department Approval: <br /> <br />Manager Reviewed: <br /> <br />Agenda Section: <br /> <br />~ <br /> <br />~~ <br /> <br />Hearings <br /> <br />Item Description: <br /> <br />Arthur Mueller request for vacation of a <br />portion of a drainage easement at 2221 and <br />2223 Ferris Lane. <br /> <br />Backqround: <br /> <br />1. The City council has previously approved a plat which <br />included a drainage easement across the northern portion of <br />the Ferriswood townhouse development on County Road C, <br />between Fairview and Cleveland. <br /> <br />2. It has been discovered that portions of two townhouse units <br />slightly encroach on this utility easement. <br /> <br />3. To clear up this encroachment and allow clear title to the <br />units, Arthur Mueller has requested that two small <br />triangular portions of the easement be vacated. <br /> <br />4. The Planning Commission reviewed this request and <br />unanimously recommend approval of a vacation of the easement <br />as requested. <br /> <br />Alternatives: <br /> <br />1. Deny the vacation request based on findings of fact that the <br />proposed vacation would be detrimental to the general <br />public health, safety; and welfare. <br /> <br />2. Approve the vacation as requested. <br /> <br />policv Objectives: <br /> <br />1. To promote a wide variety of housing types wi thin the <br />community. <br /> <br />2.
