Owasso <br />Boulevard. <br /> <br />Background: <br /> <br />1. Mr. Duddleston previously owned two lots on Owasso Boulevard. <br />Mr. Duddleston inadvertently constructed a storage shed which <br />straddled the property line between the two lots that he <br />owned. This storage shed also straddles a utility and <br />drainage easement on either side of the property line. <br /> <br />2. Mr. Duddleston is selling one of the lots and is now <br />attempting to rectify the problem by requesting vacation of <br />the utility easements and shifting the, property line such <br />that the shed will no longer straddle the property line. <br /> <br />3. The lot line shift can be handled as an administrative lot <br />division because it involves a small shift of a property line <br />and does not create an additional buildable lot. <br /> <br />4. Prior to the administrative lot split being accomplished, the <br />drainage and utility easement must be vacated. <br /> <br />5. The Planning Commission unanimously recommended approval of <br />James Duddleston' s request for vacation of a utility and <br />drainage easement at 423 S. Owasso Boulevard with the <br />condition that a similar easement be secured along the new <br />property line when the administrative lot division is <br />processed. <br /> <br />Alternatives: <br /> <br />1. Deny the vacation and require the shed to be moved. <br /> <br />2. Approve the utility easement vacation. <br /> <br />Policy Objective: <br /> <br />1. To insure accessory structures have proper setbacks as set <br />forth in the City's zoning ordinance. <br /> <br />Staff Recommendation: <br />
