BACKGROUND <br /> <br />Mr. Duddleston owns a lot on Lake Owasso which adjoins a <br />lot owned by Ralph and Nancy Palmer. Mr. Duddleston built <br />a storage shed unknowingly straddling the property line <br />with the Palmer's lot. Rather than move the storage <br />building, Mr. Duddleston and the Palmers have agreed to <br />simply move the property line separating their lots so <br />that the shed is totally on Mr. Duddleston's lot, with the <br />appropriate setback. This can be done with an <br />administrative lot split, but the lot line has an existing <br />5' drainage and utility easement on either side. Before <br />the lot split can proceed, the existing easement must be <br />vacated, which is the request before the Planning <br />Commission. <br /> <br />After the lot split, the Duddleston lot will be slightly <br />larger, and the Palmer lot will be slightly smaller, but <br />still more than the minimum required by Code. The revised <br />property line will not encroach on any required setbacks <br />on the Palmer lot. <br /> <br />2. CONCLUSION AND RECOMMENDATION <br /> <br />We recommend the vacation of the drainage and utility <br />easement be granted with the condition that a similar <br />easement be secured when the administrative lot split is <br />processed. <br />
