WHEREAS, at least four-fifths of all members of the City Council concur in this <br /> resolution; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF ROSEVILLE, MINNESOTA: <br /> 1. That the City of Roseville hereby vacates the pathway easement created by said <br /> Document No. 2016022 referred to above which is legally described as follows: <br /> The South 14 feet of the following: <br /> The East 1/2 of the West 10 acres of the South 1/2 of the West 3/4 <br /> of the Southwest 1/4 of the Southwest 1/4, Section 14, Township <br /> 29, Range 23, Ramsey County, Minnesota. <br /> 2. The vacation applies only to the pathway easement described in Provision 1 above and <br /> not to: (a) the rights of existing utilities, if any, or (b) any other easements running to or <br /> benefitting the City of Roseville <br /> 3. The City Manager is directed to execute and record a Notice of Completion of this <br /> vacation proceeding pursuant to Minnesota Statutes §412.851. The easement vacation <br /> authorized by this Resolution shall not be effective until the Notice of Completion is <br /> recorded in the office of the Ramsey County Recorder. <br /> The motion for the adoption of the foregoing resolutions was duly seconded by Council <br /> Member Willmus, and upon vote being taken thereon the following voted in favor thereof: <br /> Laliberte; McGehee; Willmus; Etten; and Mayor Roe, <br /> and the following voted against the same: None, <br /> and the following were absent: None. <br /> WHEREUPON said resolution was declared duly passed and adopted on the 21st day of <br /> April, 2014. <br />
