On April 22, 1991, the City Council approved Pope Associates <br />Inc. request for a special use permit and variance for an <br />automobile related use (emission testing facility) at 2931 <br />Partridge Road with the following conditions: <br /> <br />a. That the engineering concerns relating to storm water <br />main location be resolved. <br /> <br />b. That the landscape plan be revised to provide an <br />additional over story tree in the front yard. That <br />there be additional screening in the berm area to <br />screen over head doors, reposi tioning of trees in the <br />easement and right-of-way and relocation and screening <br />of electrical transformer. <br /> <br />c. That the development agreement occur in accordance with <br />the plans presented to the Council which include the <br />elimination of the one way exit only curb cut and <br />increased landscaping along partridge Road. <br /> <br />2 . The property owner has subsequently requested that the ci ty <br />council reconsider the requirement that the one way exit only <br />curb cut be eliminated and increased landscaping be provided <br />along Partridge Road. <br /> <br />3. This provision was added subsequent to and not part of the <br />recommendation by the Planning Commission. <br /> <br />4. The City Attorney's office has advised staff that the city <br />Council can consider reconsideration without going back to <br />the Planning Commission. The proper action would be for the <br />council to vote to reconsider and then vote on the condition <br />itself. <br /> <br />Staff Recommendations: <br /> <br />1. It is recommended that the City Council maintain the <br />condition as previously approved. <br />
