Background: 1. On April 22, 1991, the City Council approved Pope Associates Inc. request for a special use permit and variance for an automobile related use (emission testing facility) at 2931 Partridge Road with the following conditions: a. That the engineering concerns relating to storm water main location be resolved. b. That the landscape plan be revised to provide an additional over story tree in the front yard. That there be additional screening in the berm area to screen over head doors, reposi tioning of trees in the easement and right-of-way and relocation and screening of electrical transformer. c. That the development agreement occur in accordance with the plans presented to the Council which include the elimination of the one way exit only curb cut and increased landscaping along partridge Road. 2 . The property owner has subsequently requested that the ci ty council reconsider the requirement that the one way exit only curb cut be eliminated and increased landscaping be provided along Partridge Road. 3. This provision was added subsequent to and not part of the recommendation by the Planning Commission. 4. The City Attorney's office has advised staff that the city Council can consider reconsideration without going back to the Planning Commission. The proper action would be for the council to vote to reconsider and then vote on the condition itself. Staff Recommendations: 1. It is recommended that the City Council maintain the condition as previously approved.
