City ordinances require that detached garages be located in <br />rear yards and be no closer than five feet to a side or rear <br />property line. City ordinances also require dwellings to be <br />setback at least 30 feet from streets. <br /> <br />2. There is an existing detached garage at 2270 Western Avenue <br />which is located approximately 2 feet from Western Avenue and <br />4 feet from the rear property line. The existing dwelling is <br />setback 28 feet from Minnesota Avenue. <br /> <br />3 . The roof of the existing garage has a peaked section and a <br />-flat section. The applicant wishes to construct a new roof <br />on the garage so that it has a peaked roof over the whole <br />length. The applicant has also requested a variance to <br />remove the non-conforming status of the dwelling. No <br />expansion of the dwelling is proposed at this time. <br /> <br />4. City ordinances indicate that nonconforming structures cannot <br />be structurally altered. <br /> <br />5. The Minor variance Committee unanimously recommended <br />approval of this variance request. The Committee found that <br />a hardship was present and that the structure would have to <br />be moved to bring it into conformance. The proposal would be <br />to maintain the structure and would involve no expansion. <br /> <br />6. Abutting property owners have approved the proposed <br />variances. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship <br />exists to approve the variance based on the finding that <br />there are hàrdships present on the site. <br /> <br />Policy Objectives: <br /> <br />1.
