Belmont Lane. <br /> <br />Backaround: <br /> <br />1. The City ordinances require that driveways on residential <br />property be located at least 30 feet away from streets on <br />corner lots. <br /> <br />2. The ordinances require that garages be setback at least 30 <br />feet from side streets on corner lots. <br /> <br />3. Marianito Chua has driveways which enter on both Dellwood <br />Avenue and Belmont Lane. The driveway on Dellwood is setback <br />approximately 18 feet from Belmont and the driveway on <br />Belmont is located approximately 15 feet from Dellwood <br />Avenue. <br /> <br />4. Marianito Chua has an existing attached garage which is set <br />back approximately 12 feet from Dellwood Avenue. <br /> <br />5. It is the City's policy to require that driveways be brought <br />into compliance with setback requirements when streets are <br />upgraded through the pavement management program. <br /> <br />6. Mr. Chua has requested that variances be granted in order for <br />the driveways to remain at their present location and also <br />has requested a variance to clear up the non-conforming <br />status of the existing garage. <br /> <br />7. The Minor Variance Committee unanimously recommended approval <br />of the variances requested because compliance would make <br />access to the garage difficult and because of the hardship <br />required to move the existing garage to bring it into <br />compliance. The Minor Variance Committee also felt that the <br />existing layout promotes safer conditions by allowing cars to <br />enter onto the street rather than backing out onto the <br />street. <br /> <br />Alternatives: <br /> <br />1. Deny the variances, require the driveways to be installed <br />with the proper 30 foot setback, and maintain the existing <br />
