J1>
~')

REQUEST FOR COUNCIL ACTION

DATE: 3-25-91
ITEM NO.: ß./ /

Department Approval:

Manager Reviewed:

Agenda section:

~

Consent

Joseph Metzger request for a minor variance
at 1287 Ryan Avenue West.

Background:

1. City ordinances require that driveways on residential
property be located at least 30 feet away from a side street
on a corner lot.

2. Joseph Metzger has a circular driveway which has existed
since 1959. The south leg of the driveway is located
approximately 15 feet from the right-of-way instead of the
required 30 feet.

3. It is the city's policy to require that driveways be brought
into compliance with the setback requirements when the
streets are upgraded through the pavement management program.

4. Mr. Metzger has requested that a variance be granted in order
for the driveway to remain at its present location.

5. The Minor Variance Committee unanimously recommended approval
of a 15 foot variance with the condition that the driveway be
changed to enter the street at a 90 degree angle. This would
increase the distance from the intersection of the actual
curb cut and still preserve the existing lilac bushes.

Alternatives:

1. Deny the variance and require the driveway to be installed
with the proper 30 foot setback.

2. Approve the variance as requested.
Policy Obiective:

1.

To bring
with the
requiring
setback.

existing nonconforming driveways into compliance
ordinance by either granting the variance or
that they be installed with the proper 30 foot

Staff Recommendation:
