<br />5. Staff has been discussing the density of the development with <br />Heritage and in those discussions the issue of dedication of <br />the pond has been raised. Heritage suggested dedicating the <br />pond to the City. In order to analyze this issue, the <br />matter was referred to the Park and Recreation Commission for <br />recommendation. <br /> <br />6. The Park and Recreation Commission considered this matter on <br />August 4, 1992 and recommended that the land and pond not be <br />accepted in lieu of the cash requirement. <br /> <br />Staff Recommendation: <br /> <br />1. Based on the fact that the developers have stated that they <br />would not be able to reduce the density on the site in order <br />to meet the Planning Commission's special conditions, <br />Heritage Development of Minnesota, Inc.'s request for <br />rezoning from R-l to PUD at 725 W. Larpenteur Avenue should <br />be denied. <br /> <br />Council Action Reauested: <br /> <br />1. Motion to approve resolution denying Heritage Development of <br />Minnesota, Inc.'s request for rezoning from R-1 to PUD at 725 <br />W. Larpen teur Avenue. <br />
