5. Staff has been discussing the density of the development with
Heritage and in those discussions the issue of dedication of
the pond has been raised. Heritage suggested dedicating the
pond to the City. In order to analyze this issue, the
matter was referred to the Park and Recreation Commission for
recommendation.

6. The Park and Recreation Commission considered this matter on
August 4, 1992 and recommended that the land and pond not be
accepted in lieu of the cash requirement.

Staff Recommendation:

1. Based on the fact that the developers have stated that they
would not be able to reduce the density on the site in order
to meet the Planning Commission's special conditions,
Heritage Development of Minnesota, Inc.'s request for
rezoning from R-l to PUD at 725 W. Larpenteur Avenue should
be denied.

Council Action Reauested:

1. Motion to approve resolution denying Heritage Development of
Minnesota, Inc.'s request for rezoning from R-1 to PUD at 725
W. Larpen teur Avenue.
