<br />store any boats in the winter time closer than 70 feet to the <br />north property line. Mr. Hanson, representing the owner of <br />the property to the north, countered with a proposal to move <br />the screen fence 20 feet south of the property line and to <br />allow the new owner of the lot to have a two year option to <br />purchase the north 15 feet of the Slater's property. This <br />would allow them the opportunity to provide additional <br />landscaping and screening adjacent to the property. <br /> <br />6. No final agreement has been reached but discussions continue. <br /> <br />Alternatives: <br /> <br />1. Deny the request and allow the marina to operate as a non- <br />conforming use on the southern parcel only and not on the <br />northern parcel. <br /> <br />2 _ Approve the planned unit development to remove the non- <br />conforming status of the marina and allow the use of the <br />northern parcel for boat storage and vehicle parking as shown <br />on the plan as recommended by the Planning Commission. <br /> <br />3. Approve the planned unit development as requested with the <br />conditions recommended by the Planning commission and with <br />the additional condition that an agreement with the property <br />owner to the north be finalized. <br /> <br />4. Continue the request and allow the parties to continue their <br />discussions. <br /> <br />Policy Obiectives: <br /> <br />1. To insure that development occurs consistent with the City's <br />comprehensive plan and zoning ordinance requirements. <br /> <br />2. To assist businesses providing necessary services to the <br />community. <br /> <br />3. To protect the shorelines and existing lakes within the <br />community. <br /> <br />4. To insure that development does not adversely affect adjacent <br />properties. <br /> <br />Staff Recommendation: <br /> <br />1. If it is the Council's desire to have agreement finalized <br />before council action is taken, then it may want to consider <br />continuing Bob and Peggy Slater's request for rezoning from <br />R-1 to PUD and general concept and development stage approval <br />of a planned unit development at the Lake Owasso Marina at <br />2774 victoria Street until September 9, 1991 to allow an <br />agreement between the Slaters and the property owners to the <br />north to be finalized. <br />
