BACKGROUND <br /> <br />The Lake Owasso Marina site consists of two parcels. The <br />southern lot is the parcel upon which the marina use has <br />been located since before the city of Roseville was zoned, <br />in 1959. Therefore, the marina use is a legal <br />non-conforming use on this parcel. As a nonconforming <br />use, it may be maintained, but cannot be expanded on this <br />site. <br /> <br />The applicants, Bob and Peggy Slater, purchased both <br />parcels assuming that the marina use was allowed on both <br />lots. They proceeded to locate marina related parking on <br />the northern lot during summer months and boat storage <br />there in the winter. The immediately adjacent neighbor <br />has complained about this expansion of use and, for many <br />months, the city has been deliberating the proper approach <br />and actions to take. <br /> <br />Marinas are not listed as either permitted, or special <br />uses in any zoning district within Roseville. One option <br />that was initially considered was to amend the text of the <br />zoning Ordinance to allow marinas as special uses in the <br />R-1 District. The applicants could then prepare the <br />necessary plans and apply for approval. This approach was <br />rejected because it was the consensus that the City did <br />not desire to provide the opportunity for any owner of R-1 <br />zoned, lake shore property, to apply for a special Use <br />Permit for a marina. <br /> <br />The approach that was selected was to prepare and adopt a <br />new Planned unit Development Ordinance (PUD) and to <br />provide the opportunity for the owners to apply for a <br />
