<br />Lake Owasso, Case No. 2251 <br /> <br />Page 3 <br /> <br />discussion with Peggy Slater regarding this matter she <br />stated that the costs associated with complying with these <br />requirements were prohibitive. <br /> <br />Since the consideration of this matter has been going on <br />for a very long time and several factors argue against <br />continuing it again, we have drafted some exhibits to <br />assist the Planning Commission and city council in the <br />review of this matter. These exhibits were prepared <br />solely to assist the city officials in understanding the <br />proposal and to assure that the city had at least a <br />minimum public record on which to act. If this PUD is <br />approved, we strongly recommend making that approval <br />conditioned upon the preparation and submission of an <br />accurate boundary survey. <br /> <br />Before proceeding with a review of the proposal, there is <br />one more piece of pertinent background to note. In 1984 a <br />PUD was approved for the southern parcel. This PUD was <br />required by the City since there were so many principal <br />structures on the lot. The applicants wanted to build a <br />garage at the time. The PUD was approved and it <br />officially sanctioned the number of principal structures <br />on the subject property. It did not approve either the <br />marina use, or the location of the existing duplex within <br />the right-of-way of victoria Avenue. This approval was <br />also conditioned upon the dedication of an additional 10 <br />feet of r.o.w. on victoria, which was never done. <br /> <br />2. DEVELOPMENT SUMMARY <br /> <br />From our measurements of the information provided it <br />appears that the property contains approximately 41,380 <br />square feet (.95 acres). The development that is proposed <br />can be very succinctly summarized since essentially no new <br />development is proposed. About the only modifications to <br />the site that need to be evaluated relate to the northern <br />edge of the property and that will be addressed under <br />Screeninq below. <br /> <br />3. DEVELOPMENT ANALYSIS <br /> <br />Planninq Considerations <br /> <br />This property is zoned R-1 Single-Family residential. The <br />Comprehensive Plan shows the sUbject property as Low <br />Density Residential. Marinas are not currently expressly <br />allowed in any zoning district in Roseville. The approval <br />of a planned unit development would rezone the property to <br />PUD and render the marina a permitted use on both the <br />north and south lots. The marina related development <br />would be limited to what is shown on the site plan. That <br />is to say that any further development would require an <br />
