~7..~~

REQUEST FOR COUNCIL ACTION

DATE: 7-08-91

ITEM NO.: :ß - L}

Department Approval:

~

Manager Reviewed:

Agenda section:

~

Consent

Item Description:

Bob and shirley Covert request for a minor
variance at 1277 W. County Road B.

Backaround:

1. City ordinances require that residential driveways be no more
than 26 feet wide, be setback at least 5 feet from a side
property line and that driveways must be at least 10 feet
apart.

2. Bob and Shirley Covert have an existing driveway which is 47
feet wide and which is setback only 2 feet from the side
property line. The Covert's have requested a variance to
allow the driveway to remain at its existing location and
configuration.

3. The Minor variance Committee reviewed this application and
determined that there was not hardship demonstrated to
justify a 47 foot wide driveway. The Minor Variance
Committee however did unanimously recommend for a variance to
allow the 47 foot driveway to be divided into two driveways
with a 5 foot separation instead of the required 10 feet and
to have sideyard setback of 2 feet instead of the required 5
feet. The Minor Variance Committee felt this variance was
justified and necessary to continue to provide access to an
existing asphalt parking area between the garage and house.

Alternatives:

1. Deny the variances based on there being no hardship
demonstrated.

2. Approve the variances as requested.

Policy Objective:

1. To require that driveways be brought into conformance with
City ordinances at the time the street is improved during the
City's pavement management program.

2. To grant variances where hardship exists.
