ARTICLE 4. PAYMENT PROCEDURES <br />The OWNER will make progress payments on account of the Contract Price as provided in the <br />GENERAL CONDITIONS, under Section 230, and as follows: <br />4.1 Progress and final payments with be on the basis of the CONTRACTOR'S Application for <br />Payment as approved by the Parks and Recreation Director. <br />42 The OWNER shall retain 5% of the amount of each payment until final completion and <br />acceptance of all wark covered by the Contract Documents. However, when the work is <br />substantially complete, the retained amount may be reduced by the owner at its sole discretion <br />below 5% to only that amount necessary to assure completion. <br />4.3 With the written approval of Bonding Company, a sum sufficient to increase the total payments <br />of the CONTRACTOR to 98% of the Contract Price less retainage as the CITY OF <br />ROSEVILLE shall determine for all uncompleted work and unsettled claims. <br />4.4 Upon final completion of the wark and settlement of all claims and receipt of Minnesota State <br />Withholding Certificate the remainder of the Contract Price will be remitted in accordance with <br />the Contract Documents. <br />ARTICLE 5.
