Department Approval <br />�- <br />Item Description: <br />BACKGROUND <br />f�� <br />� <br />REQUEST FOR COUNCIL ACTION <br />Date: 5/12/14 <br />Item No.: 7.d <br />City Manager Approval <br />���>� <br />Approve a Resolution Regarding the Public Improvements Associated <br />with Kimco Realty Redevelopment <br />On January 9, 2006, the City Council approved the REZONING of the former Franks Nursery <br />site to Retail Business District (B-2). The conceptual site plan submitted during this process <br />included remodeling the former 18,480 sq. ft. structure; constructing an 8,000 sq. ft. eastern <br />addition; and the development of a bank on the northern portion of the parceL (PF #3680) <br />On March 26, 2007, Kimco Realty requested and the City Council approved a Conditional Use <br />Permit to install a drive-thru window at a single story, stand-alone 2,018 sq. ft. Starbucks Coffee <br />at 1800 Highway 36 (to be located between Fairview Avenue and the Golfsmith structure). (PF <br />#07-009) <br />As a part of the rezoning approval, the City required the addition of a right turn lane at the <br />intersection of the Frontage Road and Fairview. The developer has hired RLK, Inc. to design the <br />improvements. <br />The City warked with their Engineer during construction to ensure the improvements were <br />installed according to approved plans and City specifications. This wark was completed in fall <br />of 2007. Typically, accepting a project involves a two-year warranty period. However, the <br />surety has been in place on this project since that time, and the improvements have been <br />performing acceptably, that staff feels no additional warranty is needed. It is an oversight on our <br />part that the fmal acceptance has not yet been processed and the surety released. <br />POLICY OBJECTIVE <br />The City Policy requires the following steps be completed to finalize the construction project: <br />• Certification from the civil engineer in charge of the project verifying that all wark has been <br />completed in accordance with the approved plans and specifications. <br />FINANCIAL IMPACTS <br />Since this was a developer initiated proj ect, the City did not participate in the cost to construct these <br />public improvements. <br />STAFF RECOMMENDATION <br />All necessary items have been completed in accordance with project plans and specifications for <br />the public improvements constructed far Kimco Realty Redevelopment. Since all items have <br />been completed as outlined in the policy regarding final project acceptance, staff recommends <br />Page 1 of 2 <br />
