In the mid 1970's, the State of Minnesota acquired <br />approximately 70 feet of right-of-way from the Gogins <br />property to allow the realignment of the service drive <br />serving the adjacent apartments. This acquisition left the <br />Gogins dwelling with a 10 foot setback instead of the <br />required 30 foot setback. <br /> <br />2. city ordinances state that non-conforming structures such as <br />this, cannot be expanded. <br /> <br />3. The Gogins wish to add an addition onto the north side of <br />their dwelling which would be setback 12 feet. <br /> <br />4. The Minor Variance Committee unanimously recommended approval <br />of the variance because of the hardship presented by the <br />previous acquisition of the right-of-way by the State and <br />because the proposed addi tion would be no closer to the <br />right-of-way than the existing dwelling. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship <br />exists. <br /> <br />2. Approve the variance as requested. <br />Policy Obiectives: <br /> <br />1. To require non-conforming dwellings to be brought into <br />compliance over time by not allowing significant expansion or <br />investment. <br /> <br />2. To grant variances where hardships exist. <br /> <br />Staff Recommendation: <br />1. It is recommended that the City Council approve Gregory and <br />
