)31 ¿,

REQUEST FOR COUNCIL ACTION

DATE: 6-24-91
ITEM NO.: ß -- ~

Department Approval:

Manager Reviewed:

Agenda section:

P5

~

Consent

Item Description:

Sandra Armbrust and Elizabeth Hinrichs request
for a minor variance at 2200 Dellwood Street.

Background:

1. City ordinances require that driveways on corner lots be set
back 30 feet from the right-of-way of the side street.
2. It is the City's policy to require that driveways be brought
up to code or variances granted when streets are improved in
the pavement management program.

3. Sandra Armbrust and Elizabeth Hinrichs have an existing
driveway which is 7 feet from the right-òf-way line of
Sandhurst Drive. The have requested a variance to allow the
driveway to be reconstructed at its present location when the
street is improved.

4. The Minor Variance Committee unanimously recommended approval
of the variance because the driveway lines up with the
existing garage, because a conforming location would make
access to the garage difficult and would not present a
dangerous situation because Sandhurst is not a through
street.

Alternatives:

1. Deny the variance request and require the driveway to be
installed with the proper 30 foot setback.

2. Approve the variance as presented.

Policy Obiectives:

1. To bring existing non-conforming driveways into conformance
with the ordinance by either granting a variance or requiring
that they be installed with the proper 30 foot setback.

Staff Recommendation:

1. It is recommended that the City Council approve Sandra
Armbrust and Elizab~th Hinrich's request for a minor variance
at 2200 Dellwood Street.
