The City approved a lot division at 3063 N. victoria in <br />August of 1990. <br /> <br />2. Mr. Reiling has purchased this property and wishes to <br />construct a new dwelling on the new lot created. <br /> <br />3. City ordinances require that where a majority of the houses <br />on a block are constructed with a setback different from the <br />normal 30 foot setback, that the setback requirement becomes <br />the average setback on the block or 40 feet, whichever is <br />less. In this particular case, a 40 foot setback would be <br />required. <br /> <br />4. Mr. Reiling is requesting a variance to locate the house with <br />a 30 foot setback instead of the required 40 feet. <br /> <br />5. The Minor Variance Committee unanimously recommended approval <br />of the variance request based on the fact that the variance <br />is necessary to allow two mature oak trees to be saved, <br />allows less grade change for the driveway and because the <br />proposed dwelling would meet the normal 30 foot setback <br />requirement. <br /> <br />Alternatives: <br /> <br />1. Deny the variance because no hardship exists. <br /> <br />2. Approve the variance as requested. <br /> <br />Polity Obiective: <br /> <br />1. To insure that parcels are developed in accordance with the <br />standards of the zoning ordinance. <br /> <br />2. To allow the development of additional single family <br />dwellings in the community. <br /> <br />3. To grant variances where hardships exist. <br />
