Shryer Avenue. <br /> <br />Backqround: <br /> <br />1. City ordinances require that driveways on corner lots be <br />located at least 30 feet away from the right-of-way line of <br />the side street. <br /> <br />2. Jim Becker has an existing driveway which is located 8 feet <br />from the right-of-way line instead of the required 30 feet. <br /> <br />3. It is the City's policy to require that driveways be brought <br />into compliance with setback requirements when streets are <br />upgraded through the pavement management program. <br /> <br />4. The Minor Variance Committee unanimously recommended approval <br />of the variance because the driveway lines up with the <br />existing garage and does not present any safety problems at <br />the intersection. <br /> <br />Alternatives: <br /> <br />1. Deny the variance and require the driveway to be installed <br />with the proper 30 foot setback. <br /> <br />2. Approve the variance as requested. <br /> <br />Policy ImD1ications: <br /> <br />1. To bring existing non-conforming driveways into compliance <br />with the ordinance by either granting a variance or requiring <br />that driveways be installed with the proper 30 foot setback. <br /> <br />Staff Recommendations: <br /> <br />1. It is recommended that the City council approve Jim Becker's <br />request for a minor variance at 1281 W. Shryer Avenue. <br /> <br />Council Action Requested: <br /> <br />1. Motion to approve Jim Becker's request for a minor variance <br />at 1281 W. Shryer Avenue. <br />
