City ordinances require that two family dwellings have a 30 <br />foot rear yard setback. <br /> <br />2 . Mr. Wirrer is proposing to construct a three season porch <br />onto the rear of his existing unit at 2617 Fernwood ct. The <br />proposed three season porch would have a 20 foot setback on <br />the east side and a 25 foot setback on the west side instead <br />of the required 30 feet. <br /> <br />3. The Minor Variance Committee unanimously recommended approval <br />of Mr. Wirrer's request for a minor variance because of the <br />odd shaped lot, the lack of alternative locations to <br />construct the porch and the fact that it abuts the railroad <br />right-of-way. <br /> <br />Alternatives: <br /> <br />1. Deny the variance because no hardship exists. <br /> <br />2. Approve the variance as requested. <br /> <br />Policy Objectives: <br /> <br />1. To insure that development is constructed in accordance with <br />the City's zoning ordinance. <br /> <br />2. To allow improvement and expansion of dwellings within the <br />community. <br /> <br />3. Grant variances where hardships exist. <br /> <br />Staff Recommendation: <br /> <br />1. It is recommended that the City Council approve Joseph <br />Wirrer's request for a minor variance at 2617 Fernwood ct. <br />
