23~~

REQUEST FOR COUNCIL ACTION

DATE: 6-10-91

ITEM NO.: ß -I

Department Approval: Manager Revie¥ed: Agenda section:
ð ~ Consent

Item Description: Peter Nord request for a minor variance at
3107 W. OWasso Boulevard.

Background:

1. ci ty ordinances require that there be a 30 foot front yard
setback on dwellings in R-1 zoning districts.

2. Mr. Nord has an existing dwelling with a car port which
extends to within approximately 20 feet of OWasso Boulevard
instead of the required 30 feet.

3 . ci ty ordinances state that non-conforming construction such
as this cannot be expanded.

4 . Mr. Nord wishes to construct an ax17 foot addi tion on the
first level of his house over an existing foundation which
now supports the deck. The proposed addition is on the rear
of the house and conforms to all setback requirements.

5. The Minor Variance Committee unanimously recommended approval
of the variance because of the hardship necessary to bring
the existing home into compliance and because the proposed
addition does not increase the non-conformity and meets all
setback requirements.

Alternatives:

1. Deny the variance based on the finding that no hardship
exists.

2. Approve the variance as requested.

Policy Implications:

1. To requir~ non-conforming dwellings to be brought into
compliance over time by not allowing significant expansion or
investment.

2. To grant variances where hardships exist.

Staff Recommendations:
1. It is recommended that the City Council approve Peter Nord's
