OWasso Boulevard. <br /> <br />Background: <br /> <br />1. ci ty ordinances require that there be a 30 foot front yard <br />setback on dwellings in R-1 zoning districts. <br /> <br />2. Mr. Nord has an existing dwelling with a car port which <br />extends to within approximately 20 feet of OWasso Boulevard <br />instead of the required 30 feet. <br /> <br />3 . ci ty ordinances state that non-conforming construction such <br />as this cannot be expanded. <br /> <br />4 . Mr. Nord wishes to construct an ax17 foot addi tion on the <br />first level of his house over an existing foundation which <br />now supports the deck. The proposed addition is on the rear <br />of the house and conforms to all setback requirements. <br /> <br />5. The Minor Variance Committee unanimously recommended approval <br />of the variance because of the hardship necessary to bring <br />the existing home into compliance and because the proposed <br />addition does not increase the non-conformity and meets all <br />setback requirements. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship <br />exists. <br /> <br />2. Approve the variance as requested. <br /> <br />Policy Implications: <br /> <br />1. To requir~ non-conforming dwellings to be brought into <br />compliance over time by not allowing significant expansion or <br />investment. <br /> <br />2. To grant variances where hardships exist. <br /> <br />Staff Recommendations: <br />1. It is recommended that the City Council approve Peter Nord's <br />
