Oxford Street. <br /> <br />Background: <br /> <br />1. City ordinances require that there be a 30 foot setback along <br />the side street of a corner lot. <br /> <br />2. Norman and Sandra Hanson wish to construct a 20x42 foot <br />addition onto the north side of their existing dwelling. <br />This would leave a 10 foot setback from the Judith Avenue <br />right-of-way instead of the required 30 feet. <br /> <br />3. Judith Avenue adjacent to the site is dedicated but no <br />improved street exists wi thin the right-of-way. There are <br />currently no plans to construct a street on the right-of-way. <br />The City had previously considered vacating Judith Street but <br />declined to do so. <br /> <br />4. The house to the west of the site in question at 2778 <br />Churchill has been constructed with approximately a five foot <br />sideyard setback adjacent to Judith Street. <br /> <br />5. The Minor Variance Committee unanimously recommended approval <br />of the variance based on the lack of alternatives for <br />expanding the house, because the street does not exist, and <br />because the setback would be greater than the adjacent house <br />to the north. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship <br />exists. <br /> <br />2. Approve the variance as requested. <br /> <br />Policy Obiectives: <br /> <br />1. To insure that dwellings continue to meet the standards of <br />the City's zoning ordinance. <br /> <br />2. To grant variances where hardships exist. <br />
