BACKGROUND <br /> <br />KK-Three owns the Roseville Business Commons (RBC) buildings on <br />Patton Road and wants to develop a lot at the end of the cul-de-sac <br />to build RBC IV. The property will be a 5.09-acre triangular parcel <br />created from a piece of excess MnDOT right-of-way for Highway 88 <br />and a larger parcel purchased from the adjacent Williams Pipe Line <br />Company. RBC IV will be similar to the existing RBC buildings and <br />will comply with all zoning ordinance standards and will not need <br />separate approval from the Planning commission and Council. The <br />application here is only for the lot division of the Williams <br />parcel into two lots, one of which will be sold to KK-Three for RBC <br />IV. KK-Three will combine this new lot with the MnDOT lot to make <br />one tax parcel. We have reviewed the architectural plans for RBC IV <br />and have indicated to the applicant that with certain modifications <br />we can issue a building permit for the building without additional <br />zoning review. KK-Three is anxious to get the building under way <br />and have applied for and received grading and foundation permits <br />for the building at their own risk, with the explicit written <br />understanding that if the lqt division is not approved for any <br />reason, they must return the site to its original condition. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />The application is for the division of the lot and not for any of <br />. the site development issues. There are engineering concerns that <br />will be handled in the building permit process but which do not <br />affect the lot division. The property is guided Industrial and <br />zoned 1-2. The proposed use is appropriate and the lot has <br />reasonable size, configuration and access to accommodate the use. <br /> <br />3. CONCLUSION AND RECOMMENDATION <br /> <br />We recommend approval of the lot division. <br />
