Background: 1. City ordinances indicate that a pylon sign in a B-IB zoning district cannot exceed 25 feet in height or 70 sq. ft. in area and must be setback 30 feet from street right-of-way. 2. Mike Platt/Fuddruckers originally requested a variance to sign height, sign area and sign setback requirements. The applicants has subsequently revised their proposal to request only a sign height variance such that their pylon sign would be 38 feet high instead of the required 25 feet. 3. A hardship exists on the site due to the fact that when the Fuddruckers Restaurant was built, they fronted on State right-of-way. Subsequently, the State has sold the right-of- way and several buildings have been constructed between Fuddruckers and the Snelling Avenue and County Road C intersection. 4. The Roseville Planning Commission, on a 4-2 vote, recommended approval of Mike Platt/Fuddruckers request for a sign height variance at 2740 Snelling Avenue subject to the condition that the variance only applies to the current restaurant operation. Alternatives: 1. Deny the variance based on the finding that no hardship or practical difficulty exists. 2. Grant the variance based on the finding that hardship and practical difficulties exist on the site. Policy Objectives: 1. To insure that development occurs consistent with the City's zoning ordinance. 2. To grant variances where hardships or practical difficulties exist on the site.
