City ordinances indicate that a pylon sign in a B-IB zoning <br />district cannot exceed 25 feet in height or 70 sq. ft. in <br />area and must be setback 30 feet from street right-of-way. <br /> <br />2. Mike Platt/Fuddruckers originally requested a variance to <br />sign height, sign area and sign setback requirements. The <br />applicants has subsequently revised their proposal to request <br />only a sign height variance such that their pylon sign would <br />be 38 feet high instead of the required 25 feet. <br /> <br />3. A hardship exists on the site due to the fact that when the <br />Fuddruckers Restaurant was built, they fronted on State <br />right-of-way. Subsequently, the State has sold the right-of- <br />way and several buildings have been constructed between <br />Fuddruckers and the Snelling Avenue and County Road C <br />intersection. <br /> <br />4. The Roseville Planning Commission, on a 4-2 vote, recommended <br />approval of Mike Platt/Fuddruckers request for a sign height <br />variance at 2740 Snelling Avenue subject to the condition <br />that the variance only applies to the current restaurant <br />operation. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship or <br />practical difficulty exists. <br /> <br />2. Grant the variance based on the finding that hardship and <br />practical difficulties exist on the site. <br /> <br />Policy Objectives: <br /> <br />1. To insure that development occurs consistent with the City's <br />zoning ordinance. <br /> <br />2. To grant variances where hardships or practical difficulties <br />exist on the site. <br />
