J-3~ I

REQUEST FOR COUNCIL ACTION

DATE: 7-08-91

ITEM NO.: t - 3

Department Approval:

~

Manager Reviewed:

Agenda section:

~

Consent

Item Description:

David and Janice Kastelic request for a minor
variance at 945 Brooks Avenue.

Background:

1. City ordinances require that structures be setback at least
30 feet from the front or if the majority of the houses on
the block have a setback different than 30 feet, the
requirement becomes the average setback on the block. The
maximum front yard setback that the City can require is 40
feet.

2. David and Janice Kastelic wish to add an addition onto the
front of their house which would be setback 28.5 feet from
Brooks Avenue. Because the other homes on the block have
setbacks greater than 40 feet, the front yard requirement is
40 feet. Therefore, an 11.5 foot variance is required.

3. The Minor Variance Committee unanimously recommended approval
of the variance based on the lack of reasonable alternatives,
the fact that the structure would still have a 28.5 foot
setback, and because the curve of the road reduces the visual
impact.

Alternatives:

1. Deny the variance request based on there being no hardship
demonstrated.

2. Approve the variance as requested.

Policy Obieçtives:

1. To insure that construction occurs in conformance with City
zoning ordinance.

2. To allow expansion of structures on single family residential
property.

3. To approve variances where hardships are demonstrated.
