City ordinances require that structures be setback at least <br />30 feet from the front or if the majority of the houses on <br />the block have a setback different than 30 feet, the <br />requirement becomes the average setback on the block. The <br />maximum front yard setback that the City can require is 40 <br />feet. <br /> <br />2. David and Janice Kastelic wish to add an addition onto the <br />front of their house which would be setback 28.5 feet from <br />Brooks Avenue. Because the other homes on the block have <br />setbacks greater than 40 feet, the front yard requirement is <br />40 feet. Therefore, an 11.5 foot variance is required. <br /> <br />3. The Minor Variance Committee unanimously recommended approval <br />of the variance based on the lack of reasonable alternatives, <br />the fact that the structure would still have a 28.5 foot <br />setback, and because the curve of the road reduces the visual <br />impact. <br /> <br />Alternatives: <br /> <br />1. Deny the variance request based on there being no hardship <br />demonstrated. <br /> <br />2. Approve the variance as requested. <br /> <br />Policy Obieçtives: <br /> <br />1. To insure that construction occurs in conformance with City <br />zoning ordinance. <br /> <br />2. To allow expansion of structures on single family residential <br />property. <br /> <br />3. To approve variances where hardships are demonstrated. <br />
