;;. 3 šb

REQUEST FOR COUNCIL ACTION

DATE: 7-08-91
ITEM NO.: ~ ,- I

Department Approval:

1ð

Manager Reviewed:

Agenda section:

~

Consent

Item Description:

Robert Spartz request for a shoreline permit
and variance at 649 Heinel Drive.

Backqround:

1. Mr. Spartz' existing house sustained damage from falling
trees from a storm in May of 1991.

2. Mr. Spartz is proposing to replace a deck over the top of a
screen porch with an additional screened porch. The existing
structure and porch would be setback 45 feet from the lake.
The shoreline ordinance requires a 75 foot setback,
therefore, a variance is required.

3. Adjacent property owners have approved the proposed lake shore
setback variance.

4. City staff has reviewed the request and find it to be
reasonable because it does not result in the structure being
closer to the lake than it currently is.

Alternatives:

1. Deny the request based on inadequate lakeshore setback.

2. Approve the request because there is no adverse impact on the
lake.

Policv Obiectives:

1. To insure that development is consistent with the city's
lakeshore zoning ordinance to minimize adverse impact of
development on the lake.

Staff Recommendation:

1. It is recommended that the City Council approve Robert
Spartz' request for a shoreline permit and variance at 649
Heinel Drive.

Counc;il Action Reque's'ted:

1. Motion to approve Robert Spartz' request for a shoreline per-
mit and var;iance at 649 Heinel Drive.
