<br />, . <br /> <br />PLANNED UNIT DEVELOPMENT AGREEMENT <br /> <br />AGREEMENT, dated 1/ J.E.../. q2- between the ci ty of Roseville <br />(lithe city") and Cali1:>re Ridge Partnership ("Developer"). <br /> <br />1. Re est for Pla ned Unit D v t A roval. <br />,-\q /~ <br />The DEVELOPER has asked ~e CITY to a rove a Planned Uni t <br />Development with a total of~ rental townhouses on the 4.5 acre <br />parcel in the northwest quadrant of the Highway 36 and Rice <br />street intersection. The subject property is legally described <br />as follows: <br /> <br />Lot 2 , Block 1 and Outlots A and B, Werner Heights Addition, <br />Ramsey County, Minnesota and the north 200 feet of Lot 3, Michels <br />rearrangement of Lots 9-16, inclusive, Mackubin and Ingleharts <br />Addition of Outlots to st. Paul, except the west 740 feet and the <br />east 150 feet; also the west 46.5 feet of the east 150 feet of <br />the north 145 feet of said Lot 3. <br /> <br />2. Planned unit DeveloDment ADDroval. <br /> <br />The CITY hereby grants approval of the Final Development Plan and <br />subject to the DEVELOPER'S compliance with the terms and <br />conditions of this agreement. The CITY agrees to approve <br />applications for building permits, provided that said plans are <br />consistent with the exhibits which were approved at the concept <br />and final stage of the Planned unit Development process, and all <br />of the conditions of this agreement have been satisfied. <br /> <br />3. ApDroval bv the CITY. <br /> <br />The CITY hereby approves the Development as shown on the <br />following exhibits. The DEVELOPER shall develop the subj ect <br />properties in accordance with the general plans shown on the <br />exhibits. If, however, the exhibits vary from the written terms <br />of this Agreement, the written terms shall control. The exhibits <br />include: <br /> <br />A. site plan. <br />B. site sections. <br />c. Elevations. <br />D. Elevation typical unit plan. <br />E. Easement plan. <br />F. Topography plan. <br />G. Utility plan. <br />H. Landscaping plan. <br /> <br />4. Phased DeveloDment. <br /> <br />The DEVELOPER shall develop the project in a single phase. <br />Grading plans will be approved if they are in conformity with the <br />approved preliminary grading plan, and provided that the <br />
