<br />MEMORANDUM <br /> <br />DATE: July 23, 1991 <br />TO: File <br />FROM: Rick Jopke ~ <br /> <br />SUBJECT: Parking Lot Setback Interpretation for Everest Group at <br />County Road C and Long Lake Road <br /> <br />I have further reviewed the setback question and made the <br />following final determination. <br /> <br />The proposed five foot setback of the service drives on the west <br />side of the building F site (Tharaldson) and the south side of <br />the Building G site (Ruan) are acceptable based on the following: <br /> <br />1. The ci ty made a similar interpretation relating to the <br />Rosedale Marketplace site at 2401 Fairview Avenue. The <br />south side of the Rosedale Marketplace service area has a <br />similar 5 foot setback and the staff reports indicate that <br />parking meets all setback requirements. <br /> <br />2. The ordinance indicates that there should be no parking <br />within 10 feet of a side property line. The sites in <br />question do not have parking within 5 feet of a property <br />line, only service drives providing access to the rear of <br />the building. The intent here is unclear and the ordinance <br />should be clarified for future interpretation. <br />
