~j1D REQUEST FOR COUNCIL ACTION DATE: 5-11-92 ITEM NO.: ]-;2., Manager Reviewed: Agenda section: rt Consent Randall Harwood request for a minor variance at 831 Heinel Drive. Background: 1. City ordinances require that detached garages be located in rear yards. 2. Randall Harwood has an existing 24x24 garage which is located in the front yard of the property located at 831 Heinel Drive. Mr. Harwood wishes to construct a 16x24 addition onto the front of the existing garage. The existing garage has a setback of 120 feet and the proposed expanded garage would have a setback of 104 feet. 3. All affected abutting property owners have indicated their support for the variance. 4. The Minor variance Committee unanimously recommended approval of Mr. Harwood's request for a m1nor variance. The Committee felt that this was a reasonable request because of the large setback of the existing house and garage and because of the hardship that is present because the only way to bring the garage into compliance would be to relocate it behind the house which would also potentially violate shoreline setback requirements. There is also a grade change between the house and garage which presents a hardship if the garage was expanded towards the house instead of the street. Alternatives: 1. Deny the variance based on the finding that no hardship or practical difficulty exists. 2. Approve the variance request based on the finding that a hardship and/or practical difficulty exists. Policy Objectives: 1. To insure that development occurs in accordance with the City's comprehensive plan and zoning ordinances. 2. To grant variances where hardships or practical difficulties
