<br />~j1D <br /> <br />REQUEST FOR COUNCIL ACTION <br /> <br />DATE: 5-11-92 <br /> <br />ITEM NO.: ]-;2., <br /> <br /> <br />Manager Reviewed: <br /> <br />Agenda section: <br /> <br />rt <br /> <br />Consent <br /> <br />Randall Harwood request for a minor variance <br />at 831 Heinel Drive. <br /> <br />Background: <br /> <br />1. City ordinances require that detached garages be located in <br />rear yards. <br /> <br />2. Randall Harwood has an existing 24x24 garage which is located <br />in the front yard of the property located at 831 Heinel <br />Drive. Mr. Harwood wishes to construct a 16x24 addition onto <br />the front of the existing garage. The existing garage has a <br />setback of 120 feet and the proposed expanded garage would <br />have a setback of 104 feet. <br /> <br />3. All affected abutting property owners have indicated their <br />support for the variance. <br /> <br />4. The Minor variance Committee unanimously recommended approval <br />of Mr. Harwood's request for a m1nor variance. The Committee <br />felt that this was a reasonable request because of the large <br />setback of the existing house and garage and because of the <br />hardship that is present because the only way to bring the <br />garage into compliance would be to relocate it behind the <br />house which would also potentially violate shoreline setback <br />requirements. There is also a grade change between the house <br />and garage which presents a hardship if the garage was <br />expanded towards the house instead of the street. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship or <br />practical difficulty exists. <br /> <br />2. Approve the variance request based on the finding that a <br />hardship and/or practical difficulty exists. <br /> <br />Policy Objectives: <br /> <br />1. To insure that development occurs in accordance with the <br />City's comprehensive plan and zoning ordinances. <br /> <br />2. To grant variances where hardships or practical difficulties <br />
