<br />PLANNED UNIT DEVELOPMENT <br />AND SUBDIVISION AGREEMENT <br /> <br />AGREEMENT, dated IV\2bjqz... between the City of Rosevi1le (lithe <br />CITY") and Theodore Br usen ("the DEVELOPER"). <br /> <br />~~~~ <br />fùAl+-~~ <br /> <br />1. Request for Planned unit Develo~ment Approval. <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit <br />Development to renovate and expand the existing service station <br />to include a canopy over the gas pumps, additional service bays, <br />a car wash and a remodeled gas stationldelilconvenience store. <br /> <br />The property is legally described as follows: <br /> <br />section 12, Township 29, Ranqe 23, except south 158 feet of the <br />west 158 feet of the south 303 feet of the southwest 1/4 of the <br />southwest 114 (subj ect to roads and easements) in section 12, <br />Township 29, Range 23. <br /> <br />AND <br /> <br />section 12, Township 29, Range 23, south l58 feet of the west 158 <br />feet of the south 303 feet of the southwest 1/4 of the southwest <br />1/4 (subject to roads and easements) in Section 12, Township 29, <br />Range 23. <br /> <br />2. Planned unit DeveloDment Approval. <br /> <br />The CITY hereby grants approval of the Final Development Plan and <br />subject to the DEVELOPER's compliance with the terms and <br />conditions of this agreement. The CITY agrees to approve <br />applications for building permits, provided that said plans are <br />consistent with the exhibits which were approved at the concept <br />and final level of the Planned Unit Development process, and all <br />of the conditions of this agreement have been satisfied. <br /> <br />3. Approval by the CITY. <br /> <br />The CITY hereby approves the Development as shown on the <br />following exhibits. The DEVELOPER shall develop the subject <br />property in accordance with the general plans shown on the <br />exhibits. If, however, the exhibits vary from the written terms <br />of this Agreement, the written terms shall control. The exhibits <br />include: <br /> <br />A. Site and roof plan. <br />B. Floor plans, schedules, details. <br />C. Elevations. <br />D. Electrical, structural & ceiling plans, notes. <br />E. structural details, sections. <br /> <br />4. Phased Development. <br />
