City ordinances require that attached garages have a minimum <br />5 foot setback on this particular site at 2923 Hamline <br />Avenue. <br /> <br />2. Mr. Hewi tt proposes to remove an existing non-conforming <br />detached garage and replace it with an attached garage. The <br />garage would have a side yard setback of 3.8 feet at the <br />front corner and 7.9 feet at the back corner. <br /> <br />3. Affected adjacent neighbors have signed approval of the <br />variance request. <br /> <br />4. The Minor Variance Committee felt this was a reasonable <br />request based on the hardship presented by the location of <br />the house on the lot which is not perpendicular to Hamline <br />Avenue and because the location of the existing access door, <br />steps, and well room on the house make the proposed location <br />and width the only reasonable alternative. <br /> <br />Alternatives: <br /> <br />1. Deny the variance based on the finding that no hardship or <br />practical difficulty exists. <br /> <br />2. Approve the variance request based on the finding that a <br />hardship and/or practical difficulty exists on the site. <br /> <br />Policy Obiectives: <br /> <br />1. To insure that development occurs consistent with the City's <br />comprehensive plan and zoning ordinances. <br /> <br />2. To grant variances where hardships or practical difficulties <br />exist. <br /> <br />staff Recommendation: <br /> <br />1. It is recommended that the city Council approve John Hewitt's <br />
