<br />AGREEMENT <br /> <br />This is a written Agreement between Vaughn Larson & <br />Bunny Larson <hereinafter "the Larsons"} and Frank J. Rekuski <br />(hereinafter "Rekuski"). <br /> <br />Whereas, the Order of the Ramsey County District Court <br />dated August 6, 1991 in the matter of City of Roseville vs. Frank <br />Rekuski, requires that Rekuski make arrangements to move his home <br />in compliance with the Order of the Court dated January 24, 1990. <br />If said arrangements are not made by Rekuski, the City of <br />Roseville is ordered to make arrangements to move the Rekuski <br />house. <br /> <br />Whereas, the litigants are both reluctant due to <br />financial considerations, to comply with the order of the Court, <br />and the following alternative solution is therefore undertaken <br /> <br />Whereas, the Larsons of 1211 Josephine Road, Roseville <br />MN have been adversely affected by the structure built at 1225 <br />Josephine Road by Rekuski which is not in compliance with the <br />Roseville City Code. <br /> <br />Whereas, the Larsons agree that they will not take <br />future legal action in this matter if the terms of this Agreement <br />are carried out. <br /> <br />Therefore, the Larsons, 1211 Josephine Road, Roseville <br />MN consent to the variance requested by Rekuski to Roseville <br />City Code Section 7.290, paragraph 5 and Section 13.015 to" <br />accommodate the present location of the house and driveway if the <br />variance is conditioned as follows: <br /> <br />1. That Rekuski pay to the Larsons, the sum of <br />$15,000.00 (in the form of a cashier's check) by November 20, <br /> <br />EX. A <br />
