RESOLUTION WHEREAS, there is presently a judgment in the District Court of the State of Minnesota, venued in Ramsey County requiring that the house at 1225 Josephine Road to be moved approximately two feet. 1225 Josephine Road is legally described as follows: The East 1/2 of the East 170 feet of the East 438 feet of that part of Government Lot 3, Section 3, Township 29, Range 23, Ramsey County, Minnesota, lying North of the town road described in that certain final order of the Town Board filed for record in the office of the Register of Deeds in and for Ramsey County, Minnesota, on October 12, 1926, in Book 112 of Miscellaneous, Page 21, as Document Number 719978, except the West 5 feet thereof. WHEREAS, this judgment has been sustained in the Appellate Courts and is identified by the following Court File Nos. Ramsey County Court File No. C6-89-5680 Court of Appeals File No. C4-90-1024 Minnesota Supreme Court File No. C4-90-1024 WHEREAS, an agreement has been entered into between the property owners involved. WHEREAS an application for a minor variance has been filed by Frank Rekuski for the property at 1225 Josephine Road. NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROSEVILLE AS FOLLOWS: 1. The minor variance requested by Frank Rekuski is granted allowing the house at 1225 Josephine Road to remain in its present location. 2. The variance was granted on the condition that Frank Rekuski comply with all of the conditions set forth by the City Council in its Resolution No. 8713 passed on the 14th day of October, 1991. 3. The City Building Inspector has inspected the property and it appears that all of the conditions in Exhibit "A" to Resolution No. 8713 have been met. 4. The City Attorney of the City of Roseville is hereby directed to dismiss the above lawsuit. 5. Continued use of the property at 1225 Josephine Road, legally described above is contingent upon the conditions set forth in Exhibit "A" to Resolution No. 8713 on file in the I
