<br />RESOLUTION <br /> <br />WHEREAS, there is presently a judgment in the District Court <br />of the State of Minnesota, venued in Ramsey County requiring that <br />the house at 1225 Josephine Road to be moved approximately two <br />feet. <br /> <br />1225 Josephine Road is legally described as follows: <br /> <br />The East 1/2 of the East 170 feet of the East 438 feet <br />of that part of Government Lot 3, Section 3, Township <br />29, Range 23, Ramsey County, Minnesota, lying North of <br />the town road described in that certain final order of <br />the Town Board filed for record in the office of the <br />Register of Deeds in and for Ramsey County, Minnesota, <br />on October 12, 1926, in Book 112 of Miscellaneous, Page <br />21, as Document Number 719978, except the West 5 feet <br />thereof. <br /> <br />WHEREAS, this judgment has been sustained in the Appellate <br />Courts and is identified by the following Court File Nos. <br />Ramsey County Court File No. C6-89-5680 <br />Court of Appeals File No. C4-90-1024 <br />Minnesota Supreme Court File No. C4-90-1024 <br /> <br />WHEREAS, an agreement has been entered into between the <br />property owners involved. <br /> <br />WHEREAS an application for a minor variance has been filed <br />by Frank Rekuski for the property at 1225 Josephine Road. <br /> <br />NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF ROSEVILLE AS FOLLOWS: <br /> <br />1. The minor variance requested by Frank Rekuski is granted <br />allowing the house at 1225 Josephine Road to remain in its <br />present location. <br /> <br />2. The variance was granted on the condition that Frank <br />Rekuski comply with all of the conditions set forth by the City <br />Council in its Resolution No. 8713 passed on the 14th day of <br />October, 1991. <br /> <br />3. The City Building Inspector has inspected the property <br />and it appears that all of the conditions in Exhibit "A" to <br />Resolution No. 8713 have been met. <br /> <br />4. The City Attorney of the City of Roseville is hereby <br />directed to dismiss the above lawsuit. <br /> <br />5. Continued use of the property at 1225 Josephine Road, <br />legally described above is contingent upon the conditions set <br />forth in Exhibit "A" to Resolution No. 8713 on file in the <br /> <br />I <br />
